MailStrike Acceptable Use Policy

1. About this policy

This Acceptable Use Policy (the "Policy") governs your use of the MailStrike service (the "Service") operated by IT Monks Sp. z o.o. (ul. Dobrego Pasterza 19A/U4, 31-416 Kraków, Poland, KRS 0000765502). It forms part of, and is incorporated into, the MailStrike Terms of Service at https://www.mailstrike.ai/terms (the "Terms"). Capitalised terms not defined here have the meaning given in the Terms.

MailStrike is an email deliverability and warmup tool. Because it sends mail from connected mailboxes and helps build sending reputation, misuse of the Service can harm recipients, damage the reputation of shared infrastructure, and put other customers at risk. This Policy sets out what you may and may not do. By using the Service, you agree to follow it.

2. Your responsibilities as a sender

You are responsible for how you use the Service and for the mailboxes and domains you connect. You must:

  • have a valid legal basis and, where required, consent to send email to, and process the data of, the recipients you interact with, in line with applicable law including the GDPR, the ePrivacy rules, and anti-spam laws such as CAN-SPAM (US) and CASL (Canada);
  • use accurate sender identity and header information, and never disguise or falsify the origin of a message;
  • keep the mailboxes you connect secure, and only connect mailboxes you are authorised to use;
  • honour opt-out and unsubscribe requests in your own email programme; and
  • comply with the terms of your email provider (for example Google or Microsoft) and any applicable industry sender guidelines.

3. Prohibited uses

You must not use the Service to:

  • send or support unsolicited bulk email, spam, or any messaging that violates anti-spam law;
  • build, warm, or protect the reputation of mailboxes or domains that are used to send spam or unlawful email;
  • send phishing, fraudulent, deceptive, or malicious content, including malware, ransomware, spyware, or links to any of these;
  • impersonate any person, business, or organisation, or misrepresent your affiliation with anyone;
  • send content that is unlawful, defamatory, harassing, abusive, threatening, or that infringes the intellectual-property or privacy rights of others;
  • send content that is prohibited for distribution to the recipients in question under applicable law (for example certain financial, pharmaceutical, adult, or gambling content where restricted); or
  • process special categories of personal data (Article 9 GDPR) through the Service.

4. Prohibited data practices

You must not use the Service in connection with:

  • purchased, rented, scraped, harvested, or otherwise non-consented recipient lists or contact data;
  • email addresses obtained without a lawful basis; or
  • any dataset you are not authorised to use.

5. Prohibited technical activity

You must not:

  • attempt to gain unauthorised access to the Service, other accounts, or the systems or networks connected to the Service;
  • probe, scan, or test the vulnerability of the Service, or breach or circumvent any security or authentication measure, without our prior written permission;
  • interfere with or disrupt the integrity or performance of the Service, including by overloading, flooding, or spamming it;
  • use bots, scripts, or other automated means to abuse the Service or exceed applicable rate or volume limits;
  • resell, sublicense, or provide the Service to third parties except as expressly permitted in the Terms; or
  • share account credentials or allow access by anyone other than your authorised users.

6. Protecting sending reputation and shared infrastructure

Because the Service relies on shared and reputation-sensitive infrastructure, we may monitor sending patterns and Service usage to detect abuse, protect deliverability for all customers, and comply with the requirements of email providers and network operators. You must not use the Service in any way that we reasonably determine puts the security, stability, or reputation of the Service or its infrastructure at risk.

7. Enforcement

If we reasonably believe you have breached this Policy, we may, with or without notice depending on the severity and the risk involved:

  • issue a warning;
  • throttle, suspend, or restrict your use of all or part of the Service;
  • remove or disable access to offending content or configurations; or
  • suspend or terminate your account.

Where a breach threatens the security, stability, or reputation of the Service or its infrastructure, or where required by law or by an email provider, we may act immediately and without prior notice. Termination for breach of this Policy does not entitle you to any refund, consistent with the Terms. We may also cooperate with law-enforcement authorities and disclose information where legally required.

8. Reporting abuse

To report suspected misuse of the Service, contact us at hello@mailstrike.ai. We investigate credible reports and take appropriate action.

9. Changes to this policy

We may update this Policy from time to time. If we make material changes, we will notify you by email or through the Service before they take effect, consistent with the Terms. Your continued use of the Service after a change takes effect means you accept the updated Policy.
