1. Agreement to these terms
These Terms of Service (the “Terms”) form a binding agreement between you and MailStrike (“we”, “us”, “our”), operator of mailstrike.ai and the email deliverability and warmup services offered there (the “Service”). By creating an account, connecting a mailbox, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms, and “you” refers to that organisation.
2. The Service
MailStrike helps you improve and protect the sending reputation of your email accounts. The Service generates email content on our own backend, sends it on your behalf from your connected mailbox, and adjusts where messages sit in that mailbox, including moving warmup messages out of the spam folder. We do not send your real campaign mail for you, and we do not copy your existing mailbox contents into our systems.
3. Accounts
You must provide accurate account information and keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly at hello@mailstrike.ai if you suspect unauthorised use. You must be at least 16 years old to use the Service.
4. Connected Gmail and other mailboxes
When you connect a Google account, you authorise MailStrike to send mail on your behalf and to re-label messages, including removing the spam label and adding the inbox label, through the Gmail API using the gmail.modify permission. We use this access only to operate the Service: composing and sending warmup mail and moving warmup messages out of spam. We do not permanently delete your mail, and we do not store your existing mailbox contents.
Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements. You can revoke MailStrike's access at any time by disconnecting the mailbox in the Service or through your Google Account permissions page. The same applies to Microsoft 365 and custom IMAP/SMTP connections, governed by their respective providers' terms.
5. Acceptable use
You agree not to use the Service to:
- Send unsolicited bulk email, spam, or any message that violates anti-spam laws such as CAN-SPAM, GDPR, or your provider's terms.
- Distribute malware, phishing, fraudulent, deceptive, or otherwise unlawful content.
- Harass, threaten, or infringe the rights of any third party.
- Attempt to reverse-engineer, disrupt, overload, or gain unauthorised access to the Service or its infrastructure.
- Resell, sublicense, or provide the Service to third parties except as expressly permitted by us.
We may suspend or limit access if we reasonably believe your use threatens the security, integrity, or reputation of the Service or its network.
6. Fees and billing
Paid plans are billed in advance on the cycle shown at checkout. Unless stated otherwise, fees are non-refundable except where required by law. We may change pricing on renewal with reasonable notice. You are responsible for any applicable taxes.
7. Intellectual property
The Service, including its software, design, and content we provide, is owned by MailStrike and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of the data and content you provide.
8. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee any specific deliverability outcome, inbox placement, or sending reputation. Email providers control their own filtering, and results depend on factors outside our control.
10. Limitation of liability
To the fullest extent permitted by law, MailStrike will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
11. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if required to protect the Service or comply with law. On termination, your right to use the Service ends, and we delete or anonymise your data as described in the Privacy Policy. OAuth tokens and mailbox credentials are deleted when you disconnect a mailbox or close your account.
12. Changes to these terms
We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Material changes will be communicated by email or via a notice on the Service before they take effect. Continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which MailStrike is established, without regard to conflict-of-law rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, subject to any mandatory consumer protections that apply to you.
